The 1st U.S. Circuit Court of Appeals has ordered the case of the Boston Marathon bomber, Dzhokhar Tsarnaev, to be returned to a lower court to investigate claims of juror bias. Tsarnaev’s defense team argued that two jurors were dishonest during the jury selection process, with one juror allegedly making negative comments about Tsarnaev on social media and another who failed to disclose relevant information about the case. The court found that the trial judge did not adequately probe these claims, leading to the decision to send the case back for further investigation.
Tsarnaev, who was sentenced to death for his role in the 2013 bombing that killed three people and injured hundreds, may potentially have his death sentence reexamined depending on the outcome of the jury bias investigation. Regardless of the ultimate decision on his sentence, Tsarnaev will spend the rest of his life in prison, as emphasized by the appeals court.
The case has already been argued in front of the U.S. Supreme Court, with the high court reinstating Tsarnaev’s death sentence in 2022 after it was initially thrown out by the 1st Circuit in 2020. Tsarnaev was convicted on multiple charges related to the bombing, including the killing of a police officer during the brothers’ attempted getaway. The defense claims that Tsarnaev was influenced by his older brother, Tamerlan, who died in a confrontation with police following the bombing.
