A class-action lawsuit against Breyers has resulted in a nearly $9 million settlement for consumers who purchased Breyers Natural Vanilla Ice Cream in the last eight years. The lawsuit alleged that Breyers falsely advertised its ice cream as containing vanilla flavor only derived from the vanilla plant, when in reality it contained non-vanilla plant vanilla flavors and enhancers not disclosed on the packaging. As a result, eligible settlement class members can receive cash payments by submitting proof of purchase before February 19, 2025. Cash payments will be awarded at a rate of $1 per product with no limit for claims with proof of purchase, and a maximum of eight products for claims without proof of purchase. The company is also required to create a new product formula that does not include vanilla flavors derived from non-vanilla plant sources. Claim forms can be submitted online or by mail, with only one claim allowed per household. If the total value of valid claims exceeds $8.85 million, payments will be divided equally among class members. A fairness hearing is scheduled for November 21 to determine the reasonableness of the settlement. This settlement serves as a reminder for companies to accurately advertise their products to consumers to avoid future legal actions.
