Lower court to investigate possible juror bias in Boston Marathon bomber’s case


The case of the Boston Marathon bomber, Dzhokhar Tsarnaev, is being sent back to a lower court by a federal appeals court to investigate juror bias claims. The defense team claims that two jurors were dishonest during the jury selection process which led to Tsarnaev’s death sentence. One juror had retweeted a post calling Tsarnaev a “piece of garbage,” while another had been urged by a Facebook friend to ensure Tsarnaev was sent to jail. The trial judge did not thoroughly investigate these claims, prompting the appeals court to order a new penalty-phase trial to determine if Tsarnaev should be sentenced to death. Regardless of the outcome, it is emphasized that Tsarnaev will spend the rest of his life in prison. The case had previously been argued in front of the U.S. Supreme Court, which reinstated the death sentence in 2022 after it was thrown out by the 1st Circuit in 2020. Tsarnaev was convicted of the deaths of three individuals as well as other charges related to the bombing. The defense argued that he was influenced by his older brother, Tamerlan, who died in a confrontation with police after the bombing.
