Massachusetts cannabis cultivator River Valley Growers has filed a lawsuit against neighboring berry farm Nourse Farms for allegedly contaminating its marijuana crop with chemicals. The lawsuit claims that the 2022 harvest tested positive for pesticides due to Nourse Farms’ actions, resulting in millions of dollars in losses for River Valley. The lawsuit also states that this contamination has prevented River Valley from growing marijuana as planned for the next few years, potentially causing irreparable harm to the business.
This case sheds light on the challenges faced by small cannabis growers in Massachusetts, who are struggling to compete with larger multi-state operators in the industry. The strict regulations on pesticides for marijuana cultivation make it difficult for small growers like River Valley to protect their crops from contamination. The lawsuit alleges that Nourse Farms’ negligence in handling pesticides led to the ruin of River Valley’s crop and business.
The lawsuit also implicates the Cannabis Control Commission and the Massachusetts Department of Agricultural Resources for their role in the investigation of the pesticide contamination. River Valley is seeking financial damages for lost profits and other expenses, as well as permission to destroy the contaminated harvest from 2022. The outcome of this legal battle could have significant implications for the future of cannabis cultivation in Massachusetts and beyond.
