Trump administration requests Supreme Court to restart deportations of Venezuelans

The U.S. Supreme Court has temporarily halted the deportation of Venezuelan men accused of being members of the crime gang Tren de Aragua. The Trump administration declared Tren de Aragua a foreign terrorist organization and ordered the removal of its alleged members using the Alien Enemies Act. The high court blocked the removals under an administrative stay while the Venezuelans fight their deportations in court.

The Solicitor General argued that the government only had 42 minutes to respond to the Venezuelans’ emergency appeal and urged the court not to grant the relief they seek. The case is one of many against the Trump administration using the 1798 Alien Enemies Act. One case involves a Salvadoran immigrant who was removed by mistake but refused to return to Maryland, while another involves Venezuelan immigrants challenging their gang membership.

The ACLU argued that deportations should be halted, as the men were already loaded on buses and at risk of being sent to a foreign prison without a fair hearing. The Supreme Court ordered both sides to submit written arguments while the deportations are paused, with Justices Thomas and Alito opposing the order. The government argued that the Venezuelans’ request was premature as they had not gone through lower courts first.

The Supreme Court’s decision temporarily halts the deportations of Venezuelan migrants accused of being part of a criminal gang, allowing them to contest their removal in court. The case highlights the use of the Alien Enemies Act and the ongoing legal battles surrounding the Trump administration’s immigration policies.
