Judge Rules Trump Can’t Deport Venezuelans Under Alien Enemies Act

President Trump’s administration has faced legal setbacks regarding the use of the Alien Enemies Act (AEA) of 1798, especially in efforts to deport Venezuelan migrants. A federal judge in Texas, U.S. District Judge Fernando Rodriguez, ruled that the administration overstepped the boundaries of this historic wartime law. In a detailed 36-page opinion, Rodriguez stated that the Trump administration’s application of the AEA to detain or deport individuals associated with the Venezuelan gang Tren de Aragua was unjustified.

The judge emphasized that the President’s invocation of the AEA, through a formal proclamation, did not align with the statute’s intended scope or its straightforward legal definitions. This ruling effectively blocks the administration’s attempts to expedite deportations under the AEA. The Justice Department, tasked with defending the administration’s legal strategies, has yet to provide a public response to this ruling.

This decision highlights ongoing tensions surrounding immigration policies and the interpretation of laws that date back to the 18th century, drawing attention to the complexities of applying historical statutes in contemporary contexts. The ruling represents a significant pushback against the administration’s approach, particularly concerning vulnerable migrant populations from Venezuela.
