Court Rules Trump Can Maintain Control Over California National Guard


Los Angeles Mayor Karen Bass has asked the Trump administration to cease immigration raids to minimize protests in the city. Meanwhile, a U.S. appeals court has allowed Trump to maintain control over California’s National Guard while Gov. Gavin Newsom challenges the legality of this action. A panel from the 9th U.S. Circuit Court of Appeals extended a pause on a district court’s ruling that stated Trump’s mobilization of the National Guard was unlawful. Judge Charles Breyer had determined that Trump violated laws regarding presidential control over state National Guards by not coordinating with the governor and that the conditions required to federalize the troops were not met.

On June 7, amidst rising protests against Trump’s immigration policies, the president activated approximately 4,000 National Guard members and ordered 700 U.S. Marines to Los Angeles, defying Newsom’s wishes. Although Breyer’s ruling had ordered the return of the National Guard to state control, the 9th Circuit temporarily paused this decision, leading to questions about the extent of judicial oversight in these military deployments.

California’s lawsuit argues that the military presence infringes on the state’s sovereignty and misapplies laws designed to allow troop mobilization only in extreme situations, asserting that local law enforcement could effectively manage the protests. The Trump administration contends that the troops are not participating in law enforcement but are instead protecting federal properties and personnel, including U.S. Immigration and Customs Enforcement officers. The recent deployment has sparked a national conversation about military use on domestic soil, exacerbating political tensions within the city. The 9th Circuit panel includes judges appointed by both Trump and Biden.
