ACLU and CPCS Celebrate Court Ruling on SPD Misconduct Disclosure
In a landmark decision, the Massachusetts Supreme Judicial Court (SJC) has mandated that the Hampden County District Attorney’s Office (HCDAO) disclose records from a 2020 U.S. Department of Justice (DOJ) investigation into the Springfield Police Department (SPD), which revealed systemic misconduct. The court found that the HCDAO failed to meet its obligations to disclose exculpatory evidence linked to these findings.
“This ruling marks a significant triumph for due process and the rights of the accused,” stated Carol Rose, executive director of the ACLU of Massachusetts. The ACLU, in collaboration with the Committee for Public Counsel Services (CPCS) and other legal advocates, filed a lawsuit to compel the state to properly investigate and disclose findings related to police misconduct.
The court’s decision ensures that all documents reviewed by the DOJ will be shared in criminal cases, reinforcing a transformative legal principle: systemic misconduct by government entities cannot burden the individuals it affects.
